A bill to prevent the escapement of genetically altered salmon in the United States, and for other purposes.

Commentary:
This bill would make it unlawful to “ship, transport, offer for sale, sell, or purchase” or “have custody, control, or possession of, with the intent to ship, transport, offer for sale, sell, or purchase” any genetically altered fish, specifically salmon. A violation is punishable under 16 U.S.C. § 1859, for which the penalties range from 6 months to 10 years imprisonment and $100,000 to $200,000 fines depending on the nature of the offense. There is no required criminal intent in this bill or in the criminal penalty statute.
