H.R. 4496: Helping Small Business Compete Act of 2010

Sponsor: Graves (R - MO)

Official Title: To ensure that small businesses have their fair share of Federal procurement opportunities, and for other purposes.

Status:
1/21/2010: Introduced in House
1/21/2010: Referred to House Small Business Committee
1/21/2010: Referred to House Oversight and Government Reform Committee
1/21/2010: Referred to House Judiciary Committee

Commentary:
The Small Business Act establishes programs designed to provide federal benefits such as loans and contract opportunities to a variety of small and disadvantaged business concerns. Among other things, this bill calls for the inclusion of subcontracting plans that address small business opportunities in some prime contracts, and Title III of the Act calls for the promulgation of regulations that will set standards for determining whether a contractor has complied with its subcontracting plan in good faith. In addition, the bill would amend 18 U.S.C. § 1001 by adding a subsection that prohibits making a false statement, in writing or electronically, regarding “status as a small business concern or compliance with the requirements of the Small Business Act in an effort to obtain, retain, or complete a federal government contract.” A violation of 18 U.S.C. § 1001 is already punishable by, among other things, imprisonment for up to five years and a fine. The fine for violating the new subsection would be the greater of the value of the contract or $1,000,000.
