Commentary:
This bill would prohibit the sale or transfer of a handgun or handgun ammunition to a person the transferor knows or has reasonable cause to believe is under 21 years of age and would prohibit individuals under 21 from knowingly possessing handguns or handgun ammunition. Violations of the sale/transfer provision would be punishable by criminal fines and imprisonment of up to 10 years. Violations of the possession provision would be punishable by criminal fines and imprisonment of up to 1 year. In addition, the bill would punish the keeping of a loaded and unlocked or unsecured firearm in reckless disregard of the risk of a child’s ability to gain access to it, if the child actually does gain access to it, causing death or serious bodily injury. Violations of this provision would be punishable by criminal fines and imprisonment of up to 3 years. Finally, the bill would prohibit allowing a child under 18 to attend a gun show unaccompanied by an adult. Violations of this provision, whether by parents/guardians or gun show promoters, would be punishable in accordance with the state’s laws that apply to child abandonment.
